Trials of Guantanamo Detainees and the Reach of the Hamdan Decision: A Council Forum

Catch it on CAN-TV!

On July 21, the Chicago Council of Lawyers sponsored a discussion of the Supreme Court decision on the trials of Guantanamo detainees. The Council thanks Mayer Brown Rowe & Maw for the use of its facilities. CAN-TV will replay the discussion on Sunday, August 6, 2006 at 5:00 p.m. on CAN-TV19.

Tune in and see speakers Joseph Margulies (Professor of Law, MacArthur Justice Center, Northwestern University Law School) and Eric Posner (Professor of Law, University of Chicago) debate the legal consequences and implications the Guantanamo detainee trials have on law, presidential power and the U.S. Constitution.

Both speakers discussed the impact of the recent U.S. Supreme Court case of Hamdan v. Rumsfeld in which the Court barred President Bush from using military commissions to try some Guantanamo detainees. Professor Margulies concluded that Hamdan was important for what it implies. He found that the case shows "the role of the court in restraining the executive in times of armed conflict." Professor Possner stated that "Political and moral questions should be resolved by elections and protests, not by the courts."
